For purposes of this Privacy Policy, “Riveted Labs,” “we,” “us” or “our” refers to Riveted Labs and “you” and “your” refers to you, as the user of our ClassMode mobile application (the "App"). 

Riveted Labs respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes:

  • The types of information we may collect or that you may provide when you download, install, register with, access, or use the App.

  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect in this App, in email, text, and other electronic communications sent through or in connection with this App.

 Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use this App. By downloading, registering with, or using this App, you agree to this privacy policy. Information We Collect and How We Collect It

We collect information from and about users of our App:

  • Directly from you when you provide it to us.

  • Automatically when you use the App.

Information You Provide to Us (School Employees)

When you decide to use the App we ask you to provide us with certain information so that we may create your account.  This includes your school name, grade levels, student ID, geofence coordinates for the campus, time zone, and the name and email address of the individual who will administer the account for your school (“School Administrator”).

The School Administrator will provide us with information that identifies teachers and other school system users of the App. This includes employee names, email addresses.  Each individual school system user also provides a password.

The School Administrator will also import their student roster into the App.  This includes student names, email addresses, grade level, student ID, and optionally, a parent email address.

Information You Provide to Us (Students):

When students download and access the App, we request that they provide us with permission to access their location. This information is stored on the device and permits us to recognize when the student is in school, so that their device use may be monitored at that time.  We also request that students provide us with permission to send push notifications, which we use to notify students of their usage.  We also request permission to download the school profile to the App, which permits us to block access to other apps on the device if the phone is being used for a time frame that is not consistent with the school’s policies.

Automatic Information Collection and Tracking

When you download, access, and use the App, we use technology to automatically collect:

  • Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including number of times the screen locks and unlocks and location data.

  • Device Information. In order to properly configure the application, we may collect information about your mobile device and internet connection, including the device's unique device identifier, operating system, and mobile network information.

  • Location Information. This App collects information about the location of your device using location services in order to ascertain whether the device is on the school premises.

If you do not want us to collect this information do not download the App or delete it from your device. You may opt out at any time by deleting the App from your phone. For more information, see Note, however, that opting out of the App's collection of location information will cause its location-based features to be disabled.

In addition, when students download the App, we also automatically collect the device name, model, ID, serial number, OS version, storage capacity, battery level, phone number, last cloud backup, MAC address, network, cellular technology, subscriber carrier, carrier network, IMEI, roaming status, security status and additional device settings. This information is required to properly configure the App’s functionality. We also collect the list of all installed apps on iOS so we can be sure our app is still installed.


In addition, we collect the number of times each student phone is locked and unlocked, and the number of minutes that students’ phones are active.  We also receive notifications when a student removes permissions required for the App to operate properly and lock their device to prevent them from disabling the App.

To collect this information we use the Location Services feature of the device: Device location services are used to detect whether a device is within a school geofence. You can deny permissions to use location services when installing the app. If you disable or refuse location service, some parts of the App may then be inaccessible or not function properly.

Information From Children

The App is intended to be used by children in the educational context only. We only collect personal information from children for the purpose of offering our services. We never sell children’s personal information or share it for a commercial purpose.

We recognize the need to provide further privacy protections with respect to personal information we may collect from children under the age of 13 through the App. When we intend to collect personal information from children under the age of 13, we take additional steps to protect children’s privacy, including:

  • Notifying the children’s educators about our information practices with regard to children, including the types of personal information we may collect from children, the uses to which we may put that information, and whether and with whom we may share that information;

  • In accordance with applicable law, obtaining consent from educators for the collection of personal information from their children;

We share information from children under 13 with third party service providers only as necessary to support our internal operations.

Parents and educators can review information we have collected from children under 13 by contacting us at Parents and educators can also request that we delete that information and refuse to allow us to collect further information from their children by contacting .

How We Use Your Information

We do not sell or rent personal information. You maintain control over any student personal information that we receive through your and your students’ use of the App. We may use or disclose personal information that we collect or that you provide only to provide you with the App as described above and to:  

  • Provide you with the App and its contents, and any other information, products or services that you request from us.

  • Permit you to send notices to the students and parents using the App.

  • Fulfill any other lawful purpose for which you provide it.

  • Give you notices about your account, including expiration and renewal notices.

  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • Notify you when App updates are available, and of changes to any products or services we offer or provide though it.

  • Share with our third party service partners to permit them to provide App features and services on our behalf (see Third Party Service Providers section);

  • Investigate a suspected violation of the Terms of Service, suspected fraud or other unlawful activity;

  • To protect our rights and the rights and safety of other App users.

  • As may be required by law or as ordered by a court, in which event, wherever legally permissible, we shall notify you and work with you to seek to limit the scope of the required disclosure;

  • In the event of a reorganization, merger, sale, bankruptcy or other disposition of our business, in which case the transferred information will remain subject to the terms of this Privacy Policy; and

  • With your consent and as permissible under applicable laws and regulations.

We may de-identify information in accordance with applicable law, including the requirements of the Family Educational Rights and Privacy Act (FERPA), and we may use de-identified information, including aggregated, de-identified data for a variety of purposes subject to applicable law, including:

  • To demonstrate the effectiveness of the App, including in our marketing materials; and

  • To develop and improve our educational products.

  • For customized and adaptive learning.

The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize our App according to your individual interests.

  • Recognize you when you use the App.

We use location information we collect to determine whether a device is within a school’s geofence.

  •  Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device's location through the device's privacy settings. If you block the use of location information, some parts of the App may then be inaccessible or not function properly.

Who We Share Your Information With

We will not share information with individuals outside of Riveted Labs except in the following circumstances:

  • With third party service providers that perform services on our behalf. These third parties include SimpleMDM.

  • In the event that we sell or buy any business or assets, in which case we will disclose your information to the prospective seller or buyer of such business or assets;

  • If we sell, buy, merge, are acquired by, or partner with other companies or businesses, or sell some or all of our assets, in such transactions, user information will be among the transferred assets;

  • When we believe, in good faith, that disclosure is appropriate to comply with the law, a court order, or a subpoena.

  • To enforce our Terms of Service or other agreement; to protect our own rights or property or the rights, property, or safety of our users or others.

  • With your consent.

Accessing and Correcting Your Personal Information

Administrators can review and change user personal information by logging into the App and visiting a student account profile page. Parents requesting to access, review, amend, correct, or request deletion of their child’s information should contact their school administrator or

We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Data Security

We have implemented commercially reasonable measures designed to help secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored in a third party cloud-based secure servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Changes to Our Privacy Policy

We may update our privacy policy from time to time. If we make material changes to this Privacy Policy, we will post the new privacy policy on this page, and notify you by the primary email address specified in your account, an in-App alert the first time you use the App or otherwise as required by law.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
