WorMode Privacy Policy

Introduction

For purposes of this Privacy Policy, “Riveted Labs,” “we,” “us” or “our” refers to Riveted Labs and “you” and “your” refers to you, as the user of our WorkMode mobile application (the "App"). 

Riveted Labs respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes:

  • The types of information we may collect or that you may provide when you download, install, register with, access, or use the App.

  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect in this App, in email, text, and other electronic communications sent through or in connection with this App.

 Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use this App. By downloading, registering with, or using this App, you agree to this privacy policy. This policy may change from time to time (see http://www.rivetedlabs.com/workmode-privacy).

Information We Collect and How We Collect It

We collect information from and about users of our App:

  • Directly from you when you provide it to us.

  • From your Employer (“Employer Administrator”) who has enrolled your workplace in WorkMode

  • Automatically when you use the App.

Information You Provide to Us (Employee Users)

When you decide to use the App we ask you to provide us with certain information so that we may create your account.  This includes your Employer name and your phone number and/or employee ID. Your Employer Administrator will also provide us with your time zone and the geolocation coordinates of your workplace.

The Employer Administrator will provide Riveted with information that identifies employees and other users of the App. This includes employee names, email address, and phone numbers. 

Information You Provide to Us (Employees):

When employees download and access the App, we request that they provide us with permission to access their location. This information is stored on the device and permits us to recognize when the employee is at their workplace, so that their minutes of screen time may be measured during that time.  We also request that employees provide us with permission to send push notifications, which we use to provide optional notifications to employees of their usage during work. 

Automatic Information Collection and Tracking

When you download, access, and use the App, we use technology to automatically collect:

  • Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including number of times the screen locks and unlocks and location data.

  • Location Information. This App collects information about the location of your device using location services in order to ascertain whether the device is on the workplace.

If you do not want us to collect this information do not download the App or delete it from your device. You may opt out at any time by deleting the App from your phone. For more information, see http://www.rivetedlabs.com/workmode-privacy. Note, however, that opting out of the App's collection of location information will cause its location-based features to be disabled.

In addition, we collect the number of times each employee phone is locked and unlocked, and the number of minutes that employee phones are active during the workday. We also receive notifications when an employee removes permissions required for the App to operate properly and lock their device to prevent them from disabling the App.

We never at any time have access or request access to information regarding the specific uses being made of the phone, including messages, apps, or calls. Only screen time measurement data is captured

To collect screen time measurement information we use the Location Services feature of the device: Device location services are used to detect whether a device is within a workplace geofence. You can deny permissions to use location services when installing the app. If you disable or refuse location service, some parts of the App may then be inaccessible or not function properly.

How We Use Your Information

We do not sell or rent personal information. You maintain control over any employee personal information that we receive through your and your Employer Administrator’s use of the App. We may use or disclose personal information that we collect or that you provide only to provide you with the App as described above and to:  

  • Provide you with the App and its contents, and any other information, products or services that you request from us.

  • Permit you to send notices to your employer using the App.

  • Fulfill any other lawful purpose for which you provide it.

  • Give you notices about your account, including expiration and renewal notices.

  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • Notify you when App updates are available, and of changes to any products or services we offer or provide though it.

  • Investigate a suspected violation of the Terms of Service, suspected fraud or other unlawful activity;

  • To protect our rights and the rights and safety of other App users.

  • As may be required by law or as ordered by a court, in which event, wherever legally permissible, we shall notify you and work with you to seek to limit the scope of the required disclosure;

  • In the event of a reorganization, merger, sale, bankruptcy or other disposition of our business, in which case the transferred information will remain subject to the terms of this Privacy Policy; and

  • With your consent and as permissible under applicable laws and regulations.

The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize our App according to your individual interests.

  • Recognize you when you use the App.

We use location information we collect to determine whether a device is within an employer’s geofence.

  •  Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device's location through the device's privacy settings. If you block the use of location information, some parts of the App may then be inaccessible or not function properly.

Who We Share Your Information With

We will not share information with individuals outside of Riveted Labs except in the following circumstances:

  • Your employer administrator requests or receives information via email or an their administrator dashboard

  • In the event that we sell or buy any business or assets, in which case we will disclose your information to the prospective seller or buyer of such business or assets;

  • If we sell, buy, merge, are acquired by, or partner with other companies or businesses, or sell some or all of our assets, in such transactions, user information will be among the transferred assets;

  • When we believe, in good faith, that disclosure is appropriate to comply with the law, a court order, or a subpoena.

  • To enforce our Terms of Service or other agreement; to protect our own rights or property or the rights, property, or safety of our users or others.

  • With your consent.

Accessing and Correcting Your Personal Information

Administrators can review and change user personal information by logging into the App and visiting an employee account profile page. Employees requesting to access, review, amend, correct, or request deletion of their information should contact their employer administrator or support@rivetedlabs.com

You may also send us an email at support@rivetedlabs.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Data Security

We have implemented commercially reasonable measures designed to help secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored in a third party cloud-based secure servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Changes to Our Privacy Policy

We may update our privacy policy from time to time. If we make material changes to this Privacy Policy, we will post the new privacy policy on this page http://www.rivetedlabs.com/workmode-privacy, and notify you by the primary email address specified in your account, an in-App alert the first time you use the App or otherwise as required by law.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
